USER AGREEMENT

  1. INTRODUCTION

1.1.    This User Agreement ("Agreement") regulates the general terms and details regarding the use of the website ("Website") operated by training-find.com ("FIND THE TRAINING") located at https://training-find.com, under the facilities provided on the Website, by Visitors and Training Providers as defined below.

 

  1. DEFINITIONS

2.1.    The terms used in this Agreement shall be understood as defined below unless explicitly stated otherwise:

Intermediary Service Provider

Real or legal persons who provide an electronic commerce environment for the conduct of economic and commercial activities of others in accordance with Law No. 6563 on the Regulation of Electronic Commerce and other legislation.

Device

Devices capable of running current internet browsers, preferably equipped with video and voice communication features, such as computers, tablets, smartphones, and other electronic devices.

E-Commerce Legislation

Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Service Providers and Intermediary Service Providers in Electronic Commerce published in the Official Gazette No. 29457 dated 26.08.2015.

Content Provider

Real or legal persons who produce, modify, and provide any kind of information or data provided over the internet under the Internet Law.

Internet Law

Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through These Publications.

User

The person who creates an account to use the Website as a Property Owner, Contractor, Investor, or Architect.

Training Center

Entities that list and manage their business information through the facilities provided on the Website via FIND THE TRAINING in accordance with the terms of this Agreement.

FIND THE TRAINING Platform

The online platform under the domain training-find.com that enables operating training centers to introduce their businesses and training.

Training

Each of the training branches offered by businesses operating and registered on the platform.

Agreement

This User Agreement and all its annexes, whether in printed or electronic format published on the Website.

Consumer

Real or legal persons acting for non-commercial or non-professional purposes in accordance with Article 3 of Law No. 6502 on the Protection of Consumers.

Hosting Provider

Real or legal persons who provide or operate systems that host services and content under the Internet Law.

Visitor

Persons who can browse the Website without being a member, who do not hold the status of User/Training Provider.

 

  1. GENERAL TERMS

3.1.    This Agreement is valid for the Visitor and User as defined above; all persons using the Website as a Visitor, User, or Training Provider will be subject to this Agreement under different forms and conditions.

3.2.    This Agreement must be read by the Visitor before accessing the Website and performing any transactions on the Website, and by the User before becoming a member of the Website and performing any transactions related to adding training.

3.3.  This Agreement will be valid for the person using the FIND THE TRAINING platform as a Training Provider.

3.4.    If the Visitor or User does not accept part or all of the terms set forth in the Agreement, no transactions should be performed on the Website as a Visitor or User. By performing transactions on the Website, the Visitor and User will be deemed to have accepted and approved the terms of this Agreement. To avoid any doubt, it is stated that the terms of this Agreement:

3.4.1.       Are accepted by the Visitor accessing and continuing to browse the Website,

3.4.2.       Are accepted by the User who completes the membership account creation on the Website by checking the box stating "I have read and accept the User Agreement" in electronic form.

3.5.    If a legal entity wishes to perform transactions on the Website as a User, it is accepted that the legal entity is bound by this Agreement and that the representative is authorized to represent and bind the legal entity. Otherwise, the representative will be personally responsible for any debts and obligations arising, and the provisions of this Agreement will apply to the legal entity, except where the context refers to a natural person.

3.6.    FIND THE TRAINING reserves the right to make updates and changes to the Website. Any updates and changes made by FIND THE TRAINING regarding the Visitor/User on the Website from time to time are within the scope of this Agreement, and the continued use of the Website and/or the facilities provided on the Website by the Visitor/User implies implicit approval of the updates and changes.

3.7.    If FIND THE TRAINING makes any changes to this Agreement, the updated Agreement will be published on the Website through an accessible link. The updated Agreement will be effective from the moment of publication, and all current and future Visitors/Users will be subject to the updated terms.

3.8.    If the Visitor does not accept the updated Agreement, access to the Website must be terminated immediately. If the User does not accept the updated Agreement, the User's membership account on the Website must be terminated immediately in accordance with the conditions set forth in Article 18 of this Agreement.

 

  1. FIND THE TRAINING Platform

4.1.    The FIND THE TRAINING Platform is a platform that lists the training offered by member businesses and aims to connect them with those seeking training.

4.2.    The scope of the content and services provided through the FIND THE TRAINING Platform may vary for Visitors and Users, subject to FIND THE TRAINING's right to make changes.

4.2.1.   Visitors can browse the FIND THE TRAINING Platform, view published listings without details, send messages to FIND THE TRAINING regarding their requests and/or questions, and become a member of the FIND THE TRAINING Platform.

4.2.2.   Training Centers can become members of the FIND THE TRAINING Platform, share their business information, register their training centers, assign training to these centers, and submit them for admin approval. The admin has the right not to list training deemed inappropriate.

 

  1. MEMBERSHIP AND POST-MEMBERSHIP PROCESSES

5.1.    Visitors accessing the Website must become a member to view the content in detail and perform transactions as a User to receive services or as a Training Provider to offer services. Depending on the purpose of accessing and using the Website, the Visitor will also be subject to the relevant provisions of this Agreement for the User.

5.2.    A person wishing to become a member as a User on the Website is obliged to fill out the membership form on the Website and provide the following information to FIND THE TRAINING:

5.2.1.       Full name,

5.2.2.       Email address,

5.2.3.       Last four digits of the Turkish ID number,

5.2.4.       Phone number,

5.2.5.       City/district information, and

5.2.6.       User password.

(collectively referred to as "Membership Information")

5.3.    The completion of the membership required for the User to benefit from the facilities provided on the Website is established by the Visitor entering the Membership Information into the membership form, creating a user password for the profile, and the approval process. FIND THE TRAINING reserves the right to evaluate the suitability of the information for the purposes of the Website, verify the accuracy of this information, and change the membership creation methods if necessary.

5.4.    For the User to complete the membership process, the email address and phone number information provided to the Website must be accurate and up-to-date. As part of the approval process, FIND THE TRAINING may send a verification email/short message to the email address and/or phone number to confirm that they are correct and up-to-date.

5.5.    If the User forgets the user password used to log in to the membership account, the User may request a password reset option to be sent to the email address specified during the account creation process.

5.6.    The User can always update the information in their profile by logging into their account on the Website and, in accordance with the Membership Disclosure Text provided during the membership process, may include additional data and documents in their profile for the purpose of fulfilling the services offered on the Website.

5.7.    No membership can be created on the Website that manipulates the terms of use, is fake, misleading, or of any other nature. If such a situation is detected, FIND THE TRAINING is authorized to suspend or permanently delete the relevant user's membership.

 

  1. COMMON RIGHTS AND OBLIGATIONS OF USERS

6.1.    The User will access the Website through a Device, which is exclusively their responsibility to provide, and via a valid internet connection.

6.2.       The User is solely responsible for ensuring that the information requested during membership creation is accurate, complete, and up-to-date. If there are any changes to this information, the User is obliged to notify FIND THE TRAINING through the Website. The User cannot make any claims against FIND THE TRAINING for not being able to use the Website properly, being at risk of harm, or suffering harm due to incomplete and/or incorrect or outdated information provided.

6.3.       The User agrees, declares, and undertakes to act in accordance with all the terms of this Agreement, the rules announced and/or to be announced on the Website at any time, and the legal regulations, including those referred to in this Agreement, while fulfilling the membership procedures, benefiting from the services provided on the Website, providing services, or performing any transactions related to the services.

6.4.       The User cannot transfer this Agreement or the rights and obligations under it, the user profile, or account information partially or wholly to any third party without the written consent of FIND THE TRAINING; nor can they allow others to use their membership. FIND THE TRAINING cannot be held directly or indirectly responsible for any damages suffered or to be suffered by the User or third parties due to such transfers or unauthorized use. If it is determined that the User has transferred or allowed the use of their membership, FIND THE TRAINING may suspend or permanently delete the relevant user's account.

6.5.       The User cannot redirect to an e-commerce site created by themselves on the Website or to any physical/digital platform offering the same or similar services as FIND THE TRAINING, or provide information for this purpose. Communication between Users is carried out within the framework of the facilities provided on the Website. Even for communication purposes, Users cannot share personal contact information with other Users. FIND THE TRAINING cannot be held responsible in any way for any direct or indirect damages suffered by the User due to sharing personal contact information with other Users. If it is determined that the User has violated this provision, FIND THE TRAINING may suspend or permanently delete the relevant user's account.

6.6.    The User accepts and declares that they hold the status of Content Provider regarding the listings, comments, explanations, and other content they create on the Website, and that they will act in accordance with the rights and obligations granted to them under the Internet Law, and that FIND THE TRAINING has no responsibility regarding the legality of such content and/or
